19/10/2023   Wilkin Chapman: £11.5 Million Settlement Managed By Solicitors On Behalf Of Brain-Injured Client

After receiving a multimillion-pound payout from a birth injury claim, Wilkin Chapman Court of Protection team helped this client move into accommodation with a dedicated care team

£11.5 million settlement enabled independence for brain-damaged client 

No two cases are ever the same and they often require input from different specialists. For one brain-damaged client, both the medical negligence and Court of Protection team provided their expertise to obtain a significant settlement that would support our client to live a fulfilled life.

This case centred around an adult with permanent brain damage and physical disabilities that were sustained in labour. Wilkin Chapman’s medical negligence team were successful in reaching a significant settlement award.

The case was settled with a lump sum payment of £4.15 million followed by yearly payments of £218,000 until he reaches 50 years old. After reaching this age, payments will increase to £275,000 a year. Each of these payments will increase with inflation and it is anticipated that the settlement will eventually be worth in the region of £11.5 - £12 million.

Prior to this award, our client had been living in supported living accommodation with other service users which triggered his challenging behaviour. Once the settlement award was received, the Court of Protection team were able to instruct a case manager to assist them in employing a staff team to provide tailored round-the-clock care and finding a suitable property to be adapted to suit his needs.

Our client has only been in this property for around a month at the time of writing and has already shown huge progress in his speech, cognitive abilities, and willingness to engage in new activities. With the support of a therapy team and assistive technology, our client is showing signs of living a much more independent and fulfilled life.
